These Terms & Conditions govern the use of services provided by Chilltown Digital LLC (“Company,” “we,” or “us”). By engaging our services or using this website, you agree to these terms.

1. Services

Chilltown Digital LLC provides marketing strategy, content creation, photography and video services, social media consulting, branding, website support, and related digital services.

Specific project details, deliverables, and timelines are outlined in separate client agreements or proposals.

2. Client Agreements

All projects are subject to separate written agreements. In the event of a conflict, the signed client agreement takes precedence over these Terms.

3. Payments

  • Deposits and retainers may be required prior to work beginning.

  • Deposits and retainers are non-refundable.

  • Invoices are due according to the terms stated in the agreement or invoice.

  • A late fee of 5% per week may be applied to overdue balances.

Work may be paused until outstanding balances are paid.

4. Intellectual Property

Upon full payment:

  • The Client owns the final approved deliverables.

  • Drafts, concepts, internal processes, templates, methodologies, and proprietary tools remain the property of Chilltown Digital LLC.

  • AI-assisted workflows, prompts, or automation systems remain shared tools; however, final deliverables belong to the Client.

5. Portfolio Rights

Chilltown Digital LLC may display completed work in portfolios, marketing materials, or case studies after final approval unless otherwise requested in writing by the Client.

6. No Guarantee of Results

We perform services professionally and in good faith. However, we do not guarantee specific financial results, audience growth, engagement metrics, or business outcomes.

Marketing performance may be influenced by factors outside our control.

7. Third-Party Platforms

Clients acknowledge that digital platforms (including social media, advertising platforms, and search engines) operate independently. Chilltown Digital LLC is not responsible for platform changes, outages, policy updates, or algorithm adjustments that affect performance.

8. Limitation of Liability

To the maximum extent permitted by law, Chilltown Digital LLC shall not be liable for indirect, incidental, or consequential damages arising from the use of our services or website.

9. Governing Law

These Terms shall be governed by the laws of the State of New Jersey.
